Assisted reproduction and surrogacy equality

In some states and territories, assisted reproduction and surrogacy laws discriminate against same-sex couples, especially male couples and their surrogates. This means some Australians do not have access to the relational, social and legal rights and benefits afforded heterosexual individuals wishing to start a family. This inconsistency means that some LGBT individuals need to move state/territory to access these rights and benefits. This is inequitable and unjust.

Establish nationally consistent assisted reproduction and surrogacy laws allowing:

  • access to assisted reproduction and surrogacy for all couples and individuals; and
  • automatic recognition of the non-genetic parent/s at birth.
